At the end of one\u2019s life, it is undeniable that the passed ones\u2019 assets are still left and be inherited by heirs of that person. In practice, it is wise to make the Will in order to let the decedent manage the assets and to lessen the hassle of dividing the assets between the rightful heirs.<\/p>\n\n\n\n
\u7576\u4e00\u500b\u4eba\u7684\u751f\u547d\u7d50\u675f\u6642\uff0c\u4e0d\u53ef\u5426\u8a8d\u7684\u662f\u6240\u6709\u5df2\u6545\u8005\u7684\u8ca1\u7522\u4ecd\u6703\u7559\u4e0b\uff0c\u4e26\u7531\u6b64\u4eba\u7684\u7e7c\u627f\u4eba\u7e7c\u627f\u3002\u5be6\u969b\u4e0a\u660e\u667a\u7684\u505a\u6cd5\u662f\u8a02\u7acb\u907a\u56d1\uff0c\u7531\u4ea1\u8005\u7ba1\u7406\u8cc7\u7522\u4e26\u6e1b\u5c11\u5728\u5408\u6cd5\u7e7c\u627f\u4eba\u4e4b\u9593\u5206\u914d\u8cc7\u7522\u7684\u9ebb\u7169\u3002<\/p>\n\n\n\n
Under Thailand Civil and Commercial Code, the executor of an executor shall govern the estate of the passing one to let the rightful heir to receive their shares of the estate regardless of the Will is presented or not. As such, it can be determined into two situations where:<\/p>\n\n\n\n
\u6839\u64da\u6cf0\u570b\u6c11\u5546\u6cd5\uff0c\u7121\u8ad6\u662f\u5426\u8a02\u7acb\u907a\u56d1\uff0c\u907a\u56d1\u57f7\u884c\u4eba\u90fd\u61c9\u7ba1\u8f44\u4ea1\u8005\u7684\u907a\u7522\uff0c\u8b93\u5408\u6cd5\u7e7c\u627f\u4eba\u7372\u5f97\u4ed6\u5011\u7684\u907a\u7522\u4efd\u984d\u3002\u56e0\u6b64\uff0c\u53ef\u4ee5\u78ba\u5b9a\u70ba\u5169\u7a2e\u60c5\u6cc1\uff1a<\/p>\n\n\n\n
1. No Written Will<\/u><\/strong><\/p>\n\n\n\n \u7121\u66f8\u9762\u907a\u56d1<\/u><\/strong><\/p>\n\n\n\n If the deceased does not make any official Will, the estate shall be separated equally amongst the tiers of \u201cRightful Heir\u201d under Section 1629, and the rightful heir shall be as such:<\/p>\n\n\n\n \u5982\u679c\u4ea1\u8005\u6c92\u6709\u8a02\u7acb\u4efb\u4f55\u6b63\u5f0f\u907a\u56d1\uff0c\u6839\u64da\u7b2c1629\u689d\uff0c\u907a\u7522\u61c9\u5728\u201c\u5408\u6cd5\u7e7c\u627f\u4eba\u201d\u7684\u5404\u500b\u985e\u5225\u4e4b\u9593\u5e73\u5206\uff0c\u5408\u6cd5\u7e7c\u627f\u4eba\u61c9\u70ba\uff1a<\/p>\n\n\n\n 1. Direct Child(ren) of the Deceased<\/p>\n\n\n\n \u4ea1\u8005\u7684\u76f4\u7cfb\u5b50\u5973<\/p>\n\n\n\n 2. Parents of the Deceased<\/p>\n\n\n\n \u4ea1\u8005\u7684\u7236\u6bcd<\/p>\n\n\n\n 3. Direct siblings of the Deceased (with the same Parents)<\/p>\n\n\n\n \u4ea1\u8005\u7684\u89aa\u751f\u5144\u5f1f\u59ca\u59b9 (\u540c\u7236\u540c\u6bcd)<\/p>\n\n\n\n 4. Indirect siblings of the Deceased (with the same Father)<\/p>\n\n\n\n \u4ea1\u8005\u6709\u4e00\u534a\u8840\u7de3\u95dc\u4fc2\u7684\u5144\u5f1f\u59ca\u59b9(\u540c\u7236\u6216\u540c\u6bcd)<\/p>\n\n\n\n 5. Grandparents<\/p>\n\n\n\n \u7956\u7236\u6bcd<\/p>\n\n\n\n 6. Uncles, Aunt<\/p>\n\n\n\n \u53d4\u53d4\u8205\u8205\u3001\u59d1\u59d1\u963f\u59e8<\/p>\n\n\n\n Moreover, Section 1635 permits the spouse of the Deceased to possess the same tier as the Direct Child of the deceased. The right to receive the inheritances of the spouse shall be discussed later on.<\/p>\n\n\n\n \u6b64\u5916\uff0c\u7b2c1635\u689d\u5141\u8a31\u4ea1\u8005\u7684\u914d\u5076\u8207\u4ea1\u8005\u7684\u76f4\u7cfb\u5b50\u5973\u70ba\u540c\u7b49\u7d1a\u7684\u7e7c\u627f\u4eba\u3002\u914d\u5076\u7e7c\u627f\u907a\u7522\u7684\u6b0a\u5229\u5c07\u5728\u4ee5\u5f8c\u8a0e\u8ad6\u3002<\/p>\n\n\n\n However, it is not an equal split for all listed individuals. As presented in Section 1630, the law has laid down that, if the earlier tier, as stated previously, of the heirs are still alive, that alive heirs shall inherit all estate.<\/p>\n\n\n\n \u4f46\u662f\uff0c\u4e26\u4e0d\u662f\u5c0d\u6240\u6709\u5217\u51fa\u7684\u6240\u6709\u4eba\u5747\u7b49\u5206\u914d\u907a\u7522\u3002\u7b2c 1630 \u689d\u6cd5\u5f8b\u898f\u5b9a\uff0c\u5982\u679c\u4ea1\u8005\u5728\u5148\u7b49\u7d1a\u7684\u7e7c\u627f\u4eba(\u5982\u524d\u6240\u8ff0)\u4ecd\u7136\u5728\u4e16\uff0c\u6d3b\u8457\u7684\u7e7c\u627f\u4eba\u61c9\u7e7c\u627f\u6240\u6709\u8ca1\u7522\u3002<\/p>\n\n\n\n If there are multiple individuals in the same tier, the estate shall be split amongst that tier of heirs equally. This does not cut the spouse\u2019s right to receive inheritances whatsoever.<\/p>\n\n\n\n \u5982\u679c\u540c\u4e00\u985e\u5225\u6709\u591a\u500b\u7e7c\u627f\u4eba\uff0c\u907a\u7522\u61c9\u5e73\u5206\u7d66\u8a72\u985e\u5225\u7684\u7e7c\u627f\u4eba\u3002\u9019\u4e0d\u6703\u524a\u6e1b\u914d\u5076\u7372\u5f97\u4efb\u4f55\u907a\u7522\u7684\u6b0a\u5229\u3002<\/p>\n\n\n\n [Example #1:<\/strong> if the Deceased has 2 children, no spouse, and 1 direct brother. By the virtue of Section 1630, the estate shall be split amongst 2 children 50% equally. The Direct brother will receive nothing.]<\/p>\n\n\n\n [\u8209\u4f8b#1<\/strong>\uff1a\u5982\u679c\u4ea1\u8005\u6709 2 \u500b\u5b69\u5b50\u3001\u6c92\u6709\u914d\u5076\u3001\u6709 1 \u500b\u89aa\u751f\u7684\u5144\u5f1f\u3002\u6839\u64da\u7b2c 1630 \u689d\uff0c\u907a\u7522\u61c9\u5e73\u5747\u5206\u914d\u7d66 2 \u500b\u5b69\u5b50 50%\u3002\u89aa\u751f\u7684\u5144\u5f1f\u5c07\u4e00\u7121\u6240\u7372\u3002]<\/p>\n\n\n\n The law also makes an exception, if the Parents of the deceased still exist, Parents shall receive the inheritances in a ratio as the children of the deceased will receive equally.<\/p>\n\n\n\n \u6cd5\u5f8b\u4e5f\u898f\u5b9a\u4f8b\u5916\uff0c\u5982\u679c\u4ea1\u8005\u7684\u7236\u6bcd\u4ecd\u7136\u5065\u5728\uff0c\u7236\u6bcd\u61c9\u4f9d\u4ea1\u8005\u5b50\u5973\u5e73\u5747\u7372\u5f97\u7684\u6bd4\u4f8b\u7372\u5f97\u907a\u7522\u3002<\/p>\n\n\n\n [Example #2:<\/strong> if the deceased has 2 children, no spouse, parents of the deceased still alive, and 1 direct brother. By the virtue of Section 1630, the estate shall be split amongst 2 children and 2 alive parents of 25% equally on each rightful heir. The Direct brother still receives nothing.]<\/p>\n\n\n\n [\u8209\u4f8b#2<\/strong>\uff1a\u5982\u679c\u4ea1\u8005\u67092\u500b\u5b69\u5b50\u3001\u6c92\u6709\u914d\u5076\u3001\u4ea1\u8005\u7684\u7236\u6bcd\u4ecd\u7136\u5728\u4e16\u3001\u6709 1\u500b\u89aa\u751f\u7684\u5144\u5f1f\u3002\u6839\u64da\u7b2c 1630 \u689d\uff0c\u907a\u7522\u61c9\u5206\u914d\u7d66 2 \u500b\u5b69\u5b50\u548c 2 \u500b\u5728\u4e16\u7684\u7236\u6bcd\uff0c\u6bcf\u4f4d\u5408\u6cd5\u7e7c\u627f\u4eba\u5747\u5206 25%\u3002\u89aa\u751f\u7684\u5144\u5f1f\u4ecd\u7136\u6c92\u6709\u6536\u5230\u4efb\u4f55\u6771\u897f\u3002]<\/p>\n\n\n\n 1.2 Right of the Spouses of the Deceased<\/p>\n\n\n\n \u4ea1\u8005\u914d\u5076\u7684\u6b0a\u5229<\/p>\n\n\n\n According to Section 1635, if the spouse of the deceased is still alive, he\/she shall inherit the estate regardless of the tiers as mentioned earlier. However, the ratio of shares in the estate is different and NOT <\/strong>an equal split and shall be as such:<\/p>\n\n\n\n \u6839\u64da\u7b2c1635 \u689d\uff0c\u5982\u679c\u4ea1\u8005\u7684\u914d\u5076\u4ecd\u7136\u5728\u4e16\uff0c\u4e0d\u8ad6\u4e0a\u8ff0\u985e\u5225\u61c9\u7e7c\u627f\u907a\u7522\u3002\u4f46\u662f\u7372\u5f97\u907a\u7522\u7684\u6bd4\u4f8b\u4e0d\u540c\uff0c\u4e26\u975e<\/strong>\u5747\u5206\uff0c\u800c\u662f\uff1a<\/p>\n\n\n\n 1.2.1 If, Children are still alive, the Equal share shall be split in a ratio equal to what children are entitled to.<\/p>\n\n\n\n \u5982\u679c\u5b50\u5973\u4ecd\u7136\u5065\u5728\uff0c\u61c9\u6309\u7167\u5b50\u5973\u6709\u6b0a\u7372\u5f97\u7684\u6bd4\u4f8b\u5e73\u5206\u3002<\/p>\n\n\n\n [Example #3:<\/strong> if the deceased has 2 children, 1 spouse, parents of the deceased still alive, and 1 direct brother. By the virtue of Section 1635, the estate shall be split amongst the spouse, 2 children, and 2 alive parents of 20% equally on each rightful heir. The Direct brother still receives nothing.]<\/p>\n\n\n\n [\u8209\u4f8b#3:<\/strong> \u5982\u679c\u4ea1\u8005\u67092\u540d\u5b69\u5b50\u30011 \u540d\u914d\u5076\u3001\u4ea1\u8005\u7684\u7236\u6bcd\u9084\u5065\u5728\u3001\u6709 1\u500b\u89aa\u751f\u7684\u5144\u5f1f\u3002\u6839\u64da\u7b2c 1635 \u689d\uff0c\u907a\u7522\u61c9\u7531\u914d\u5076\u30012 \u500b\u5b69\u5b50\u548c 2 \u500b\u5728\u4e16\u7684\u7236\u6bcd\u5e73\u5747\u5206\u914d 20% \u7d66\u6bcf\u500b\u5408\u6cd5\u7e7c\u627f\u4eba\u3002\u89aa\u751f\u7684\u5144\u5f1f\u4ecd\u7136\u6c92\u6709\u6536\u5230\u4efb\u4f55\u6771\u897f\u3002]<\/p>\n\n\n\n 1.2.2 If the Direct Sibling is still alive OR <\/strong>the parent is still alive, the spouse will be inherited 50% of the deceased\u2019s estate. The rest shall be split amongst the numbers of Parents and Direct Siblings.<\/p>\n\n\n\n \u5982\u679c\u89aa\u751f\u7684\u5144\u5f1f\u59d0\u59b9\u4ecd\u7136\u5065\u5728\u6216<\/strong>\u7236\u6bcd\u4ecd\u7136\u5065\u5728\uff0c\u914d\u5076\u5c07\u7e7c\u627f\u4ea1\u8005\u907a\u7522\u7684 50%\u3002\u5176\u9918\u7684\u61c9\u4f9d\u7167\u7236\u6bcd\u548c\u89aa\u751f\u7684\u5144\u5f1f\u59d0\u59b9\u7684\u4eba\u6578\u5747\u5206\u3002<\/p>\n\n\n\n 1.2.3 If the Deceased has no children, no alive parents, and no direct siblings but an Indirect sibling or Uncle\/Aunt still alive, the spouse will be inherited 1\/3 of the deceased\u2019s estate. This ratio also applied if no alive Uncle\/Aunt but Grandparents are still alive.<\/p>\n\n\n\n \u5982\u679c\u4ea1\u8005\u6c92\u6709\u5b69\u5b50\u3001\u6c92\u6709\u5065\u5728\u7684\u7236\u6bcd\u3001\u4e5f\u6c92\u6709\u89aa\u751f\u7684\u5144\u5f1f\u59d0\u59b9\uff0c\u4f46\u6709\u4e00\u500b\u6709\u4e00\u534a\u8840\u7de3\u95dc\u4fc2\u7684\u5144\u5f1f\u59d0\u59b9\u6216\u53d4\u53d4\/\u963f\u59e8\u4ecd\u7136\u5728\u4e16\uff0c\u914d\u5076\u5c07\u7e7c\u627f\u6b7b\u80051\/3\u7684\u907a\u7522\u3002\u5982\u679c\u6c92\u6709\u5065\u5728\u7684\u53d4\u53d4\/\u963f\u59e8\u4f46\u7956\u7236\u6bcd\u4ecd\u5065\u5728\uff0c\u9019\u500b\u6bd4\u7387\u4e5f\u9069\u7528\u3002<\/p>\n\n\n\n 1.2.4 If no there is no rightful heir as stated in Section 1629, the Spouse shall inherit 100% of the estate.<\/p>\n\n\n\n \u5982\u679c\u6c92\u6709\u7b2c1629\u689d\u898f\u5b9a\u7684\u5408\u6cd5\u7e7c\u627f\u4eba\uff0c\u914d\u5076\u61c9\u7e7c\u627f 100% \u7684\u907a\u7522\u3002<\/p>\n\n\n\n 2. Legally Certified Will is Existing<\/strong><\/p>\n\n\n\n \u6709\u5408\u6cd5\u907a\u56d1<\/strong><\/p>\n\n\n\n As per Section 1646, the Will shall be counted as the \u201cContract\u201d which will be executed after the Estate owner is passed. The will can be made in 2 forms.<\/p>\n\n\n\n \u6839\u64da\u7b2c1646\u689d\uff0c\u907a\u56d1\u61c9\u7b97\u4f5c\u201c\u5408\u7d04\u201d\uff0c\u5c07\u5728\u907a\u7522\u6240\u6709\u8005\u904e\u4e16\u5f8c\u57f7\u884c\u3002\u907a\u56d1\u53ef\u4ee5\u6709\u5169\u7a2e\u5f62\u5f0f\u3002<\/p>\n\n\n\n 2.1 Verbal Will<\/u><\/strong><\/p>\n\n\n\n \u53e3\u982d\u907a\u56d1<\/u><\/strong><\/p>\n\n\n\n In the case where the estate owner could not execute the will as the circumstances does not allow the written Will to be formed, the Verbal Will can be executed with the presence of 2 witnesses. After the will is formed, the witnesses shall be presented at the District Office to ratify the Will. After the ratification, it is deemed that such Verbal Will is fully enforced after the death of the Estate Owner. If no ratification has been made, it shall be deemed void entirely and the process of inheritances of the deceased shall proceed as if the will is never made in the first place.<\/p>\n\n\n\n \u5982\u679c\u56e0\u60c5\u6cc1\u4e0d\u5141\u8a31\u8a02\u7acb\u66f8\u9762\u907a\u56d1\u800c\u5c0e\u81f4\u907a\u7522\u6240\u6709\u4eba\u7121\u6cd5\u57f7\u884c\u907a\u56d1\uff0c\u5247\u53ef\u4ee5\u5728 2 \u540d\u898b\u8b49\u4eba\u5728\u5834\u7684\u60c5\u6cc1\u4e0b\u57f7\u884c\u53e3\u982d\u907a\u56d1\u3002\u8a02\u7acb\u907a\u56d1\u5f8c\uff0c\u898b\u8b49\u4eba\u61c9\u5230\u6c11\u653f\u4e8b\u52d9\u8655\u6838\u51c6\u907a\u56d1\u3002\u4e00\u65e6\u6838\u51c6\u5f8c\uff0c\u5373\u8996\u70ba\u8a72\u53e3\u982d\u907a\u56d1\u5728\u5c4b\u4e3b\u904e\u4e16\u5f8c\u5b8c\u5168\u751f\u6548\u3002\u5982\u679c\u672a\u88ab\u6838\u51c6\uff0c\u907a\u56d1\u5c07\u88ab\u8996\u70ba\u5b8c\u5168\u7121\u6548\uff0c\u4ea1\u8005\u7684\u7e7c\u627f\u904e\u7a0b\u5c07\u5982\u540c\u5f9e\u672a\u8a02\u7acb\u907a\u56d1\u9032\u884c\u3002<\/p>\n\n\n\n In order to make the Ratification, Copy of the Estate Owner\u2019s ID, House registrar, and 2 aforementioned witnesses must be presented at the District Office.<\/p>\n\n\n\n \u8981\u4f7f\u907a\u56d1\u6838\u51c6\uff0c\u5fc5\u9808\u5728\u5730\u5340\u8fa6\u516c\u5ba4\u51fa\u793a\u5c4b\u4e3b\u8eab\u4efd\u5f71\u672c\u3001\u623f\u5c4b\u767b\u8a18\u548c\u4e0a\u8ff0 2 \u540d\u8b49\u4eba\u3002<\/p>\n\n\n\n 2.2 Written Will<\/u><\/strong><\/p>\n\n\n\n \u66f8\u9762\u907a\u56d1<\/u><\/strong><\/p>\n\n\n\n There are 3 ways to execute the Will, which are as followed:<\/p>\n\n\n\n \u57f7\u884c\u907a\u56d1\u67093\u7a2e\u65b9\u5f0f\uff0c\u5206\u5225\u5982\u4e0b\uff1a<\/p>\n\n\n\n 2.2.1 Unofficial\/Self-Written Will<\/strong><\/p>\n\n\n\n \u975e\u5b98\u65b9\/\u81ea\u7acb\u907a\u56d1<\/strong><\/p>\n\n\n\n As per Book 6, Title 3 of the Thailand Civil and Commercial Code, the forms of the Will must be met which includes the Name of the Estate Owner, Date, and Signatures of the Estate Owner in order to be considered a Valid Will. This type of will have not required ratification, and validity shall be executed after the death of the estate owner.<\/p>\n\n\n\n \u6839\u64da\u300a\u6cf0\u570b\u6c11\u5546\u6cd5\u300b\u7b2c 6 \u5377\u7b2c 3 \u7bc7\uff0c\u907a\u56d1\u7684\u683c\u5f0f\u5fc5\u9808\u7b26\u5408\u898f\u5b9a\uff0c\u5305\u62ec\u907a\u7522\u6240\u6709\u4eba\u7684\u59d3\u540d\u3001\u65e5\u671f\u548c\u907a\u7522\u6240\u6709\u4eba\u7684\u7c3d\u540d\uff0c\u624d\u80fd\u88ab\u8996\u70ba\u6709\u6548\u907a\u56d1\u3002\u6b64\u985e\u907a\u56d1\u7121\u9700\u6838\u51c6\uff0c\u5728\u907a\u7522\u6240\u6709\u4eba\u53bb\u4e16\u5f8c\u751f\u6548\u3002<\/p>\n\n\n\n 2.2.2 Official Will<\/strong><\/p>\n\n\n\n \u5b98\u65b9\u907a\u56d1<\/strong><\/p>\n\n\n\n The most recommended way to fully executed the Will is to make such a will at the District Office. This type of will is called an \u201cOfficial Will\u201d.<\/p>\n\n\n\n \u5b8c\u5168\u57f7\u884c\u907a\u56d1\u7684\u6700\u63a8\u85a6\u65b9\u5f0f\u662f\u5728\u6c11\u653f\u4e8b\u52d9\u8655\u7acb\u907a\u56d1\u3002\u9019\u7a2e\u985e\u578b\u7684\u907a\u56d1\u7a31\u70ba\u201c\u5b98\u65b9\u907a\u56d1\u201d\u3002<\/p>\n\n\n\n Such will be made in front of Government Officials and will be fully executed after the death of the Estate Owner.<\/p>\n\n\n\n \u9019\u5c07\u5728\u653f\u5e9c\u5b98\u54e1\u9762\u524d\u9032\u884c\uff0c\u4e26\u5c07\u5728\u907a\u7522\u64c1\u6709\u4eba\u904e\u4e16\u5f8c\u5168\u9762\u57f7\u884c\u3002<\/p>\n\n\n\n In order to make the Official Will, an original and a Copy of the Estate Owner\u2019s ID, Certification of ownership in the estate, and 2 witnesses must be presented at the District Office. In the case of the Estate, the owner is over 60 years old, Medical Certification is also required. The Fee shall be 50 THB per Official Will.<\/p>\n\n\n\n \u70ba\u4e86\u88fd\u4f5c\u6b63\u5f0f\u907a\u56d1\uff0c\u5fc5\u9808\u5728\u5730\u5340\u8fa6\u516c\u5ba4\u51fa\u793a\u907a\u7522\u64c1\u6709\u4eba\u8eab\u4efd\u8b49\u7684\u6b63\u672c\u53ca\u5f71\u672c\u3001\u907a\u7522\u6240\u6709\u6b0a\u8b49\u660e\u4ee5\u53ca 2 \u540d\u8b49\u4eba\u3002\u4ee5\u907a\u7522\u4f86\u8aaa\uff0c\u907a\u7522\u64c1\u6709\u4eba\u5e74\u6eff60\u6b72\uff0c\u9084\u9700\u8981\u91ab\u7642\u8b49\u660e\u3002\u6bcf\u4efd\u6b63\u5f0f\u907a\u56d1\u7684\u8cbb\u7528\u70ba 50 \u6cf0\u9296\u3002<\/p>\n\n\n\n 2.2.3 Confidential Will<\/strong><\/p>\n\n\n\n \u4fdd\u5bc6\u907a\u56d1<\/strong><\/p>\n\n\n\n The Confidential will shall only be opened after the Estate Owner is passed. No edits or summon of the wills can be made. It can either be made Official or Unofficial types of will.<\/p>\n\n\n\n \u4fdd\u5bc6\u907a\u56d1\u53ea\u6709\u5728\u696d\u4e3b\u904e\u4e16\u5f8c\u624d\u80fd\u958b\u555f\u3002\u4e0d\u80fd\u5c0d\u907a\u56d1\u9032\u884c\u7de8\u8f2f\u6216\u53ec\u96c6\u3002\u53ef\u4ee5\u662f\u5b98\u65b9\u6216\u975e\u5b98\u65b9\u985e\u578b\u7684\u907a\u56d1\u3002<\/p>\n\n\n\n In order to make the Confidential Will, an original and a Copy of the Estate Owner\u2019s ID, a Copy of the House registrar, a Sealed envelope with the will inside, and 2 witnesses must be presented at the District Office.<\/p>\n\n\n\n \u70ba\u4e86\u88fd\u4f5c\u4fdd\u5bc6\u907a\u56d1\uff0c\u5fc5\u9808\u5728\u5730\u5340\u8fa6\u516c\u5ba4\u51fa\u793a\u907a\u7522\u6240\u6709\u8005\u8eab\u4efd\u8b49\u7684\u6b63\u672c\u53ca\u5f71\u672c\u3001\u623f\u5c4b\u767b\u8a18\u5f71\u672c\u3001\u88dd\u6709\u907a\u56d1\u7684\u5bc6\u5c01\u4fe1\u5c01\u4ee5\u53ca 2 \u540d\u8b49\u4eba\u3002<\/p>\n\n\n\n Management of Estate after Death<\/strong><\/p>\n\n\n\n \u904e\u4e16\u5f8c\u907a\u7522\u7ba1\u7406<\/strong><\/p>\n\n\n\n <\/strong>After the death of the Estate Owner, it is required by law that that Estate Manager shall be established by the Court order in order to legally executed the division of the Estate to the rightful heir. According to Section 1649, the Manager shall be established \u201cAs per the Will of the Deceased\u201d which can be any person that the deceased wishes to manage the estate after death.<\/p>\n\n\n\n \u907a\u7522\u6301\u6709\u4eba\u53bb\u4e16\u5f8c\uff0c\u6cd5\u5f8b\u898f\u5b9a\u61c9\u6839\u64da\u6cd5\u9662\u547d\u4ee4\u8a2d\u7acb\u4e00\u540d\u907a\u7522\u7ba1\u7406\u4eba\uff0c\u4ee5\u4fbf\u5408\u6cd5\u5c07\u907a\u7522\u5206\u914d\u7d66\u5408\u6cd5\u7e7c\u627f\u4eba\u3002\u6839\u64da\u7b2c 1649 \u689d\uff0c\u7ba1\u7406\u4eba\u61c9\u201c\u6839\u64da\u4ea1\u8005\u7684\u907a\u56d1\u201d\u6210\u7acb\uff0c\u53ef\u4ee5\u662f\u4ea1\u8005\u5e0c\u671b\u5728\u904e\u4e16\u5f8c\u7ba1\u7406\u907a\u7522\u7684\u4efb\u4f55\u4eba\u3002<\/p>\n\n\n\n If no will is presented or no text in the Will indicates anyone to be the Estate Manager, the rightful heir of the Deceased shall have the right to establish themselves as the manager by submitting the request to the Court and letting the Court order so.<\/p>\n\n\n\n \u5982\u679c\u6c92\u6709\u51fa\u793a\u907a\u56d1\u6216\u907a\u56d1\u6c92\u6709\u4efb\u4f55\u6587\u5b57\u8868\u660e\u4efb\u4f55\u4eba\u5c07\u6210\u70ba\u907a\u7522\u7ba1\u7406\u4eba\uff0c\u4ea1\u8005\u7684\u5408\u6cd5\u7e7c\u627f\u4eba\u6709\u6b0a\u901a\u904e\u5411\u6cd5\u9662\u63d0\u4ea4\u8acb\u6c42\u4e26\u8b93\u6cd5\u9662\u4e0b\u4ee4\u4f86\u78ba\u7acb\u81ea\u5df1\u70ba\u907a\u7522\u7ba1\u7406\u4eba\u3002<\/p>\n\n\n\n Disposed of Rightful Heir<\/strong><\/p>\n\n\n\n \u6c7a\u5b9a\u5408\u6cd5\u7e7c\u627f\u4eba<\/strong><\/p>\n\n\n\n <\/strong>In the Law, there are 2 primary ways that the Rightful Heir can be disposed of which is:<\/p>\n\n\n\n \u5728\u6cd5\u5f8b\u6709\u5169\u7a2e\u200b\u200b\u4e3b\u8981\u65b9\u5f0f\u53ef\u4ee5\u6c7a\u5b9a\u5408\u6cd5\u7e7c\u627f\u4eba\uff0c\u5373\uff1a<\/p>\n\n\n\n 1. By Will<\/p>\n\n\n\n \u907a\u56d1<\/p>\n\n\n\n If the Estate Owner wishes to dispose his\/her rightful heir, such statement shall be made in the Will or made into documents and submitted a such document to the District Offices. Such persons\u2019 share of inheritances shall be cut from the estate entirely.<\/p>\n\n\n\n \u5982\u679c\u907a\u7522\u64c1\u6709\u4eba\u6b32\u6c7a\u5b9a\u5176\u5408\u6cd5\u7e7c\u627f\u4eba\uff0c\u9808\u5728\u907a\u56d1\u4f5c\u51fa\u9673\u8ff0\u6216\u88fd\u6210\u6587\u4ef6\uff0c\u4e26\u5411\u6c11\u653f\u4e8b\u52d9\u8655\u63d0\u4ea4\u8a72\u7b49\u6587\u4ef6\u3002\u9019\u4e9b\u4eba\u7684\u7e7c\u627f\u4efd\u984d\u61c9\u5b8c\u5168\u5f9e\u907a\u7522\u4e2d\u6263\u9664\u3002<\/p>\n\n\n\n If such disposal is made at the District Offices, an Original ID and a Copy, Copy of the House registrar, and 2 witnesses shall be presented at the district office. A Fee of 20 THB shall be paid with an extra 20 THB for maintaining such document.<\/p>\n\n\n\n \u5982\u679c\u6b64\u6c7a\u5b9a\u662f\u5728\u5730\u5340\u8fa6\u516c\u5ba4\u9032\u884c\uff0c\u61c9\u5728\u5730\u5340\u8fa6\u516c\u5ba4\u51fa\u793a\u8eab\u4efd\u8b49\u6b63\u672c\u548c\u5f71\u672c\u3001\u623f\u5c4b\u767b\u8a18\u5f71\u672c\u4ee5\u53ca 2 \u540d\u8b49\u4eba\u3002\u61c9\u652f\u4ed8\u8cbb\u7528 20 \u6cf0\u9296\uff0c\u4e26\u984d\u5916\u652f\u4ed8 20 \u6cf0\u9296\u7528\u65bc\u7dad\u8b77\u6b64\u6587\u4ef6\u3002<\/p>\n\n\n\n 2. By Virtue of Law<\/p>\n\n\n\n \u4f9d\u6cd5<\/p>\n\n\n\n According to Section 1606, the Rightful Heir shall be automatically disposed of and deemed \u201cunqualified\u201d if the circumstances show that the individual is:<\/p>\n\n\n\n \u6839\u64da\u7b2c 1606 \u689d\uff0c\u5408\u6cd5\u7e7c\u627f\u4eba\u61c9\u88ab\u81ea\u52d5\u6c7a\u5b9a\u4e26\u88ab\u8996\u70ba\u201c\u4e0d\u5408\u683c\u201d\u5982\u679c\u8a72\u500b\u4eba\u662f\uff1a<\/p>\n\n\n\n a. being sentenced on the crimes of intentionally and unlawfully causing the Estate owners or other rightful heirs in tiers before themselves to die;<\/p>\n\n\n\n \u56e0\u6545\u610f\u3001\u975e\u6cd5\u81f4\u4f7f\u907a\u7522\u64c1\u6709\u4eba\u6216\u5176\u4ed6\u985e\u5225\u5408\u6cd5\u7e7c\u627f\u4eba\u904e\u4e16\u88ab\u5224\u5211;<\/p>\n\n\n\n b. accused the Estate Owner to received Death Penalties and later proved that such accusation is false;<\/p>\n\n\n\n \u63a7\u544a\u907a\u7522\u64c1\u6709\u4eba\u88ab\u5ba3\u5e03\u904e\u4e16\u3001\u5f8c\u4f86\u8b49\u660e\u70ba\u865b\u5047;<\/p>\n\n\n\n c. knowingly that the Estate Owner is being killed, but ignore and refuse to report a such crime (this shall not be applied to the persons under 16 years of age, incompetent persons or the murderer is the spouses, parents, or child of such persons);<\/p>\n\n\n\n \u660e\u77e5\u907a\u7522\u64c1\u6709\u4eba\u88ab\u6bba\uff0c\u537b\u7f6e\u4e4b\u4e0d\u7406\u4e26\u62d2\u7d55\u5831\u6848\uff08\u4e0d\u9069\u7528\u65bc\u672a\u6eff 16 \u6b72\u8005\u3001\u7121\u884c\u70ba\u80fd\u529b\u8005\u6216\u5147\u624b\u70ba\u8a72\u7b49\u4eba\u7684\u914d\u5076\u3001\u7236\u6bcd\u6216\u5b50\u5973);<\/p>\n\n\n\n d. willingly and intentionally threatens the estate owner to write the wills or prevent the amendments to that will and;<\/p>\n\n\n\n \u81ea\u9858\u4e26\u6545\u610f\u5a01\u8105\u907a\u7522\u64c1\u6709\u4eba\u5beb\u4e0b\u907a\u56d1\u6216\u963b\u6b62\u5c0d\u8a72\u907a\u56d1\u7684\u4fee\u6539\uff0c\u4ee5\u53ca;<\/p>\n\n\n\n e. falsifying\/destroying\/concealing the part or entire will.<\/p>\n\n\n\n \u507d\u9020\/\u7834\u58de\/\u96b1\u779e\u90e8\u5206\u6216\u5168\u90e8\u907a\u56d1\u3002<\/p>\n\n\n\n Forfeiture of Inheritances<\/strong><\/p>\n\n\n\n \u62cb\u68c4\u7e7c\u627f\u6b0a<\/strong><\/p>\n\n\n\n The Rightful Heir, by their wishes, can waive their right in inheritances by submitting the Forfeiture at the District Offices.<\/p>\n\n\n\n \u5408\u6cd5\u7e7c\u627f\u4eba\u53ef\u4ee5\u6839\u64da\u81ea\u5df1\u7684\u610f\u9858\uff0c\u5728\u5730\u5340\u8fa6\u4e8b\u8655\u63d0\u4ea4\u6587\u4ef6\u62cb\u68c4\u5176\u7e7c\u627f\u6b0a\u3002<\/p>\n\n\n\n An Original ID, a copy of the ID, a Copy of the House Registrar, the Death Certification of the Estate Owner, and 2 witnesses shall be presented. If such persons is a minor, legally declared incompetent persons, or could not manage their own matters, evidence of Parents, Guardian and Curator and the Court\u2019s Order shall be presented at the District Office as well.<\/p>\n\n\n\n \u61c9\u51fa\u793a\u8eab\u4efd\u8b49\u6b63\u672c\u53ca\u5f71\u672c\u3001\u623f\u5c4b\u767b\u8a18\u5f71\u672c\u3001\u696d\u4e3b\u6b7b\u4ea1\u8b49\u660e\u548c 2 \u540d\u8b49\u4eba\u3002\u5982\u679c\u9019\u4e9b\u4eba\u662f\u672a\u6210\u5e74\u4eba\u3001\u4f9d\u6cd5\u5ba3\u4f48\u70ba\u7121\u884c\u70ba\u80fd\u529b\u7684\u4eba\u3001\u6216\u7121\u6cd5\u8655\u7406\u81ea\u5df1\u7684\u4e8b\u52d9\uff0c\u9084\u61c9\u5411\u5730\u5340\u8fa6\u516c\u5ba4\u51fa\u793a\u7236\u6bcd\u3001\u76e3\u8b77\u4eba\u548c\u76e3\u8b77\u4eba\u7684\u8b49\u64da\u4ee5\u53ca\u6cd5\u9662\u7684\u547d\u4ee4\u3002<\/p>\n\n\n\n <\/p>\n\n\n\n
