When deciding to file a civil lawsuit, it&#039;s important to know basic procedure.<\/p>\n\n\n\n<p id=\"viewer-lmq6\">Civil disputes inevitably occur in our daily lives, such as contract disputes, property distribution, or unjust enrichment. When deciding to file a civil lawsuit, it is important to understand the basic procedures.<\/p>\n\n\n\n<p id=\"viewer-beqt4\">Following is the basic introduction of civil lawsuit:<\/p>\n\n\n\n<p id=\"viewer-anf2v\">The following is a basic introduction to civil litigation:<\/p>\n\n\n\n<p id=\"viewer-c4tfv\">1. Determine the right Court to file a lawsuit<\/p>\n\n\n\n<p id=\"viewer-9q6o1\">Make sure you file your case in the correct court<\/p>\n\n\n\n<p id=\"viewer-2cf7l\">First is to decide whether to start the case at Kwaeng Court or Provincial Court. In our earlier article \u201cIntroduction of Different Types of Courts in Thailand\u201d (<a href=\"https:\/\/0rz.tw\/Yckqd\" target=\"_blank\" rel=\"noreferrer noopener\">https:\/\/0rz.tw\/Yckqd<\/a>), we have introduced the function of Kwaeng Court and other courts which handle specific kind of civil cases.<\/p>\n\n\n\n<p id=\"viewer-cprlf\">The first step is to decide whether to initiate proceedings in a local or provincial court. In our previous article \u201cIntroduction to Thai Courts\u201d (<a href=\"https:\/\/0rz.tw\/Yckqd\" target=\"_blank\" rel=\"noreferrer noopener\">https:\/\/0rz.tw\/Yckqd<\/a>) has described the functions of district courts and other courts specialized in handling specific civil cases.<\/p>\n\n\n\n<p id=\"viewer-fbptg\">On the other hand, Kwaeng Court is in charges of civil cases that:<\/p>\n\n\n\n<p id=\"viewer-a8rf8\">On the other hand, provincial courts deal with the following civil cases:<\/p>\n\n\n\n<p id=\"viewer-asccp\">\u2013 The amount is more than 300,000 baht;<\/p>\n\n\n\n<p id=\"viewer-8fgtd\">The amount involved exceeds 300,000 baht;<\/p>\n\n\n\n<p id=\"viewer-4o8ra\">\u2013 The case isn&#039;t related to money, which the claimant requests to cease the disturbance, annoyance or damage;<\/p>\n\n\n\n<p id=\"viewer-a7b0g\">The case is not about money, the plaintiff is asking for an end to harassment, obstruction or harm;<\/p>\n\n\n\n<p id=\"viewer-9ghsa\">\u2013 It&#039;s a non-contentious case, such as requesting court order to determine the incapacitated of a person.<\/p>\n\n\n\n<p id=\"viewer-8v9o\">For non-litigation cases, such as requesting a court order to determine that a person is incapacitated.<\/p>\n\n\n\n<p id=\"viewer-t7qt\">In case in a province where there is no Kwaeng Court, the Provincial Court will take the role of Kwaeng Court.<\/p>\n\n\n\n<p id=\"viewer-bgc5g\">If a province does not have a district court, the provincial court will act as a district court.<\/p>\n\n\n\n<p id=\"viewer-2337f\">In addition, normally a lawsuit should be filed to Court within the province where the defendant resides or the place where the dispute happens. It also determines whether there&#039;s an agreement which indicate where to file a lawsuit when there is a dispute. For further information, please check Thai Civil Procedure Code, Section 4(1).<\/p>\n\n\n\n<p id=\"viewer-a6h1p\">In addition, cases are usually litigated in the province where the defendant is located or where the dispute arises. In addition, whether there is a contract that stipulates the court to sue when a dispute occurs will also determine the location of the lawsuit. Preparing relevant documents<\/p>\n\n\n\n<p id=\"viewer-3go52\">Prepare relevant documents<\/p>\n\n\n\n<p id=\"viewer-26sgs\">\u2013 Complaint and relevant supporting evidence;<\/p>\n\n\n\n<p id=\"viewer-cpm81\">Complaint and relevant evidence;<\/p>\n\n\n\n<p id=\"viewer-46u97\">\u2013 Power of Attorney: in case you appoint a lawyer(s);<\/p>\n\n\n\n<p id=\"viewer-3l1ph\">Letter of attorney: if a lawyer is appointed;<\/p>\n\n\n\n<p id=\"viewer-bvr71\">\u2013 Official documents of personal information of defendant(s);<\/p>\n\n\n\n<p id=\"viewer-dtvoa\">Official documents concerning the defendant\u2019s personal information;<\/p>\n\n\n\n<p id=\"viewer-637q8\">\u2013 Affidavit.<\/p>\n\n\n\n<p id=\"viewer-dprto\">Affidavit.<\/p>\n\n\n\n<p id=\"viewer-7v0b5\">3. Paying relevant fees<\/p>\n\n\n\n<p id=\"viewer-6hdj2\">Pay relevant fees<\/p>\n\n\n\n<p id=\"viewer-49f1j\">The relevant fees should be paid include:<\/p>\n\n\n\n<p id=\"viewer-b7kso\">The relevant fees include:<\/p>\n\n\n\n<p id=\"viewer-1k40q\">\u2013 Court fees, which are fees charge by court, being paid when starting a lawsuit or filing an appeal. The court fees for monetary and non-monetary cases are different. There are also some fees required under Thai Civil Procedure Code.<\/p>\n\n\n\n<p id=\"viewer-desgo\">Court fees payable to the court at the time of prosecution or appeal. Court fees are different for monetary and non-monetary cases, and the Thai Civil Procedure Code also stipulates other relevant court fees.<\/p>\n\n\n\n<p id=\"viewer-efc2s\">\u2013 Other court fees in civil cases<\/p>\n\n\n\n<p id=\"viewer-csjg6\">Other court costs<\/p>\n\n\n\n<p id=\"viewer-8tof1\">For example, fee for certification requesting judgment or its order shall be 50 baht.<\/p>\n\n\n\n<p id=\"viewer-4rbde\">For example, the verification fee for confirming a judgment or order is 50 baht.<\/p>\n\n\n\n<p id=\"viewer-a8hn5\">\u2013 Other expenses: such as witness fees, travel expenses, and appraisal cost.<\/p>\n\n\n\n<p id=\"viewer-437k7\">Other expenses: such as witness fees, travel expenses, and appraisal fees.<\/p>\n\n\n\n<p id=\"viewer-2dajl\">According to Section 149 under Thai Civil Procedure Code, if a plaintiff or a defendant is not able to pay its court fees, they may file an application by motion to exempt such fees.<\/p>\n\n\n\n<p id=\"viewer-euf3\">According to Section 149 of the Thai Civil Procedure Code, if the plaintiff or defendant is unable to contribute to the court costs, they may file an application through a motion to waive such costs.<\/p>\n\n\n\n<p id=\"viewer-6n4oa\">4.
